The four convicts in the Nirbhaya gangrape and murder case will be hanged on March 3 at 6 am, Delhi’s Patiala Court said on Monday.
Earlier, the date of execution was fixed at February 1 by the Patiala court, but it stayed the order on January 31 saying all the convicts had not yet exhausted the legal remedies available to them.
The Delhi High Court on February 5 had directed the convicts to exhaust the remedies available to them within a week. Failing this, the law would take its own course against the convicts, the court had said.
After the February 5 order, one of the convicts Vinay Sharma had moved a mercy petition which got rejected by the President. Vinay then challenged the rejection through a writ petition in Supreme Court which was also rejected.
However, advocate AP Singh, on behalf of Akshay and Vinay told the court that Akshay has prepared a fresh mercy petition which will be moved to the President. He said that in his earlier mercy petition, all the facts could not be accurately represented because of his ignorance and poverty. Singh also said that Vinay was suffering from mental illness and hence cannot be executed.
Additionally, advocate Ravi Qazi on behalf of Pawan told the court that his client plans to move a curative petition and a mercy petition.
Mercy petitions of three other convicts, Mukesh, Vinay and Akshay have already been rejected by the President.
Six persons were arrested and charged with rape and murder of a 23-year-old medical student in Delhi in 2012, which came to be known as the Nirbhaya case. One of the accused was a minor and was tried in the juvenile justice court. He was released after three years. Another accused – Ram Singh – had allegedly committed suicide in Tihar Jail.
