Supreme Court to scrutinise the validity of 10 percent quota for economically backward, allows scheme to roll

The Supreme Court will scrutinise the validity of the recent 10 per cent reservation bill for the economically backward passed by the Central government.

The top court will hear the petitions filed against the government’s 10 per cent quota in jobs and education. Allowing the scheme to roll, the Supreme Court has sent a notice to the government today giving it four weeks to respond.

Introduced, ratified by the Parliament and enacted within a very short span of time, the controversial reservation bill is ‘unconstitutional’ as per the petitions filed against it. It exceeds the cap of 50 per cent set by the Supreme Court in 2006.

Additionally, it is also in violation of the Mandal Commission directive of 1992 that ‘economic criteria’ is not to be regarded as the ‘sole basis for reservation’, the petitions argue.
